Initiatives, Referendums, and Recalls
Citizen-Led Measures in Fairfax
California law gives voters the power to directly propose, challenge, or remove laws and elected officials through initiatives, referendums, and recalls. These processes are highly regulated and have strict deadlines.
Before beginning any effort, you must schedule an appointment with the Town Clerk. Meeting with the Clerk early is critical to ensure you follow the required steps and avoid mistakes that could invalidate your petition.
Initiative Measures
Purpose: An initiative allows voters to propose a new ordinance or amend/repeal an existing one.
How it works
- File a Notice of Intention with the Town Clerk, including the proposed text.
- The Town Attorney prepares an impartial ballot title and summary.
- Proponents publish the notice, then circulate petitions for voter signatures.
- If enough valid signatures are collected, the Town Council must either:
- Adopt the measure as written, or
- Place it on the ballot for voters to decide.
Referendum Measures
Purpose: A referendum allows voters to approve or reject a new ordinance adopted by the Town Council.
How it works
- Proponents circulate a petition within 30 days after Council adoption of the ordinance.
- If sufficient valid signatures are collected, the ordinance is suspended.
- The Town Council must then either:
- Repeal the ordinance, or
- Submit it to voters at an election.
Recall Election
Purpose: A recall allows voters to remove an elected official before their term ends.
How it works
- Proponents serve and file a Notice of Intention to Recall with the Town Clerk.
- The notice is published and the recall petition format must be reviewed and approved by the Clerk.
- Proponents gather voter signatures within the required timeframe.
- If enough valid signatures are collected, the Town Council must order a special election.
- If a majority votes “Yes,” the official is removed and the office is filled according to state law.
