The Chair shall maintain order at the meetings in accordance with Robert’s Rules of Order and the Planning Commission has the responsibility to be a model of respectful behavior in order to encourage community participation and citizen input at Planning Commission meetings. The Planning Commission and the audience are expected to refrain from using profane language and/or ridiculing the character or motive of Planning Commission members, staff, or members of the public and to maintain the standards of tolerance and civility.
Conduct: All interested persons are invited to participate in public hearings. In order to give all interested persons an opportunity to be heard and to ensure the presentation of all points of view, members of the audience should: (1) Limit their presentation to three minutes; (2) Provide their comments by e-mail as described above; (3) State their view and concerns succinctly; and, (4) Submit any new documents to the Planning Staff, first, directly, or via e-mail at Planning@townoffairfax.org to be entered into the record.
PUBLIC COMMENTS ON NON-AGENDA ITEMS
Anyone who wishes to address the Planning Commission on matters not on the agenda, but within the jurisdiction of the Planning Commission, must do so by e-mail, in person, or via Zoom in the manner described above. Presentations will be limited to three minutes, or as otherwise established by the Planning Commission Chair.

PUBLIC HEARING ITEMS
Application for a Revocable Encroachment Permit to construct an approximately eight-foot section of mountain bicycle path connecting a proposed bike trail in the County of Marin starting at the Tamarancho Boy Scout Camp to the Iron Springs right-of-way. Work within the Fairfax City limits and Iron Springs right-of-way include construction of an approximately eight foot length of 3-foot tall retaining wall, graded bike path, installation of a post and block, bike speed reducing feature, stop sign, and section of split rail fencing; Adjacent to APN # 174-052-02; Marin Council Boy Scouts of America, applicants; David and Suzanne Warner, owners; Lead Agency, Marin County Community Development Agency, has prepared a Negative Declaration for the project.
Applications for a Design Review Permit, a Sign Permit and a Conditional Use Permit to make minor modifications to the exterior of an existing gas station/automobile repair shop replacing car repair area access doors with two windows and an ADA accessible front door and remodeling the interior of building to provide an ADA compliance bathroom, convert the auto repair shop into a convenience market, gas and store service counter and a bulk sales item area that would feature car servicing items such as motor oil and specialty pet food; Assessor’s Parcel No. 001-223-09; CC Central Commercial Zone; KN Properties, applicants/owners; CEQA categorically exempt, § 15301(a).
Modification of an existing Conditional Use Permit (CUP) to allow operation of massage therapy school from the Fairfax Community Church building; Assessor’s Parcel No. 001-150-36; RM Multiple Family Zone; Marin School Massage and the Healing Arts, applicant; Fairfax Community Church, United Church of Christ, owner: CEQA categorically exempt, § 15301(a).
Review of sixth cycle Fairfax General Plan Safety Element and Land Use Element considering recommendation to the Town Council for adoption.
