LAND ACKNOWLEDGEMENT

The Fairfax Town Council acknowledges that we are located on the un-ceded ancestral lands of the Coast Miwok people of present-day Marin County. We honor with gratitude the land itself, and all of its ancestors: past, present, and emerging.

MEETING PROTOCOL

The Mayor shall maintain order at the meetings. The Council has the responsibility to be a model of respectful behavior in order to facilitate the conduct of the people’s business and encourage civil engagement in Town Council meetings.

The Council and the audience are expected to refrain from using profane language and/or ridiculing the character or motives of council members, staff, or members of the public and to maintain the standards of tolerance and civility. Please turn off all cellular phones or place them in silent mode. Shouting, clapping, booing, stomping, or other disruptive behavior during public comment or council deliberation is discouraged in order to provide a respectful and comfortable environment for all residents to express their point of view. Clapping is acceptable for items such as police pinnings, proclamations, welcoming new staff and council members, and other celebratory announcements.

The Town Council will review the agenda at 10:00 P.M. to ascertain which items, if any, will be continued to another meeting. Any matter not started by 11:30 P.M. will be continued to an adjourned or regular council meeting unless the Council votes to suspend this rule.

OPEN TIME FOR PUBLIC EXPRESSION This is the time for the public to address the Council on matters not listed on the agenda. Each speaker is limited to two (2) minutes. The Council cannot take action or discuss items not on the agenda, as restricted by state law (Gov. Code §54954.2). If there are more speakers after 30 minutes, Open Time will continue at the end of the agenda.

REGULAR AGENDA

1. Public Hearing: Introduction of an Ordinance Amending Chapter 8.44 (Clean Indoor And Outdoor Air And Health Protection – Smoking Regulations) By Amending Definitions, Establishing Minimum Pricing For Packages Of Cigarettes, Cigars, Little Cigars, And Smokeless Tobacco; Prohibiting The Redemption Of Coupons And Discounts, Banning The Sale Of Electronic Smoking Devices, Heated Smoking Systems And Tobacco Or Nicotine Pouches; And Imposing Other Requirements (~30 minutes)

2. Establish a Town Council Subcommittee to Collaborate with the Fairfax Open Space Committee on Name Recommendations for the Wall Property (~15 Minutes)
3. Discuss and Consider Town Council Boards and Committee Assignments for 2026 (~30 Minutes)

      4. CONSENT CALENDAR The Council can approve all items on the Consent Calendar in one action. Alternatively, any Council or staff member can remove items for separate discussion and voting. Public comments for Consent Calendar items are taken collectively, not item by item. During this period, speakers may address any item on the Consent Calendar, with each speaker allotted up to two minutes and limited to one comment session. (~10 Minutes)

a. Receive Financial Statement and Disbursement Reports for November 2025

b. Receive report on Councilmembers’ assignments, committees, and activities in December 2025

c. Approve Minutes from the November 5, 2025 Town Council Meeting

d. Receive Report on Gas Tax Audit Findings
