Earlier today, on January 8, 2026, the Town of Fairfax issued a response letter to the applicant regarding the proposed 95 Broadway mixed-use project. The applicant had requested clarification to the conditions of approval issued for the project. Both letters may be found on the project website (see link at the bottom of this posting).
The project was approved through a ministerial process on November 22, 2025. The approval included a list of conditions that the developer will need to meet in order to obtain building permits. On January 7, the applicant requested some clarifications to the conditions in letter sent by the law firm of Holland & Knight. Town staff has reviewed the letter and will be amending the project conditions of approval in response.
The Town is obligated to comply with state law and approve this project ministerially subject to objective design and development standards. There is significant risk in denying a housing project in California due to a myriad of State housing laws.
